Pursuant to this
Agreement,
"ThePublishersClub,
LLC" and
"Client"
agree to the
following terms:
1) Order
Tracking /
Statistics provided
by ThePublishersClub is final
and binding.
2)
ThePublishersClub
is not liable to
replace duplicate
records in the
client's database. A
person may signup
for similar offers
at different
websites and at
different times.
3)
ThePublishersClub
will supply a client
with 10% additional
leads to cover for
possible invalid and
duplicate leads.
Under no
circumstances can a
client demand any
additional
compensation/refund
for duplicate leads.
However, if invalid
telephone numbers
and invalid email
addresses exceed 10%
of the order
quantity, then
ThePublishersClub will
replace the invalid
leads. After this
replacement,
ThePublishersClub will not be
liable for any
further
replacements. No
overage/extra leads
are provided on sale
orders.
4)
ThePublishersClub
will make every
effort to fulfill an
order within 2
business days after
order placement.
However,
ThePublishersClub
may take up to 15
business days to
completely fulfill
an order.
5) In no
event shall either
party be liable for
special, indirect,
incidental, or
consequential
damages, including,
but not limited to,
loss of use, or loss
of profits.
6)
ThePublishersClub
sell prospect lists
only. We DO NOT
guarantee sales or
conversions. By
placing your order
you agree that you
can not chargeback
citing
dissatisfaction with
quality or service.
7) Unpaid
orders are subject
to a 1.5% monthly
surcharge and the
Client is also
liable to pay any
and all
legal/attorney fees
which was required
to recover the
payment.
8) Only
first time customers
purchasing lead
packages costing
under $50 are
eligible for the
100% money back
guarantee. To be
eligible a customer
must notify
ThePublishersClub
within 5 business
days upon receiving
leads. Customers
purchasing Email
Blasts are not
eligible for the
100% money back
guarantee.
9) The
relationship between
ThePublishersClub and the
Client will be
governed by, and
construed in
accordance with, the
laws of the State of
North Dakota. Client
hereby irrevocably
consents to the
exclusive
jurisdiction of the
courts of the State
of North Dakota and
the federal courts
situated in the
State of North
Dakota in connection
with any action
arising between the
parties.
10) If any
of the terms are
held unenforceable,
the reminder of the
terms shall remain
in effect. Please DO
NOT place your order
if you do not agree
with our terms and
conditions.
11)
ThePublishersClub
reserves the right
to terminate this
agreement anytime,
with or without
cause. Termination
notice may be
provided via email
or any other public
means and will be
effective
immediately.
12) By
agreeing to this
Agreement, the
Client warrants that
Client (or
Authorized
Representative of
the Client) is at
least 18 years of
age, and that there
is no legal reason
that Client cannot
enter into a binding
contract. |
